Nagle Law Group is listed as a 2024 “Best Law Firm” by U.S. News and Best Lawyers in America©, and is further listed as one of the 500 Go-To Law Firms by In-House Law Departments at the Top 500 Companies for Corporate Transaction Work.
Nagle Law Group attorneys possess an extensive breadth and depth of experience in every aspect of commercial real estate law from purchase agreement negotiation, to financing, acquiring, and developing retail projects, supporting shopping center management, and representing both end-users and developers in connection with leasing. Our business-oriented approach identifies all relevant legal issues and weaves the client’s business considerations into their resolution. Along with my partner, Walter Howl, and two experienced, real estate paralegals, Nagle Law Group is able to provide a full range of legal services to many individuals, national and regional retailers, restaurants, and developers. Nagle Law Group is dedicated to the principles of excellence, integrity and outstanding client service.
Rated by US News and World Report as a 2024 “Best Law Firm” and A/V rated by Martindale Hubbell (the highest rating possible), Robert Nagle has also been listed as a Best Lawyer since 2008 and is himself A/V rated. Nagle Law Group is more than just a law firm: it is as much a retailer as any of its clients, with a “service, service, service” mantra that has helped set the firm apart not only amongst other boutique law firms in Arizona, but from larger firms as well.
Landlord and Tenant Representation
Both landlords and tenants may face challenging legal issues in lease transactions and disputes. Nagle Law Group’s tenant leasing team has extensive and unique experience in the negotiation and documentation of all types of leases, including space leases, build-to-suit leases, pad leases, anchor tenant leases, and in-line shop leases, having represented many national tenants as well as numerous other local tenants and businesses. We understand the interplay of competing occupancy issues including building design and operation, protecting tenants in the event of delays, common area maintenance expenses, considerations for expanding tenant space, and lease term options. Our attorneys work with clients on both stand-alone transactions and in connection with national large scale leasing programs. In doing so, we have completed numerous projects with the national retailers above. We also assist clients by drafting form leases, renewing existing leases, and interpreting disputed lease provisions that are in dispute. With a clear understanding of our clients’ business objectives, both with respect to store development and management, our group has the ability to successfully complete retail leasing transactions in a conscientious, expeditious, and cost effective manner, protecting a client’s rights and remedies.
On the landlord side, Nagle Law Group presently represents both large and small shopping center developers. Prior to forming Nagle Law Group, Robert Nagle had extensive shopping center development and leasing experience working on behalf of a prominent real estate developer. This equally extensive work on behalf of landlords and developers gives Nagle Law Group an in-depth understanding of what is important to each party.
We understand our client’s objectives and provide practical, innovative solutions.
Shopping Center and Outparcel Acquisition, Development and Disposition
In addition to Landlord and Tenant leasing work, Nagle Law Group’s shopping center acquisition and development practice covers all phases of the development process, including structuring, negotiating, and documenting development agreements, acquisitions and assemblages, declarations, covenants, operation and easement agreements and reciprocal easement agreements, joint ventures and leasing and sales. Our group has participated in the negotiation and closing of hundreds of millions of dollars of shopping center development transactions and is knowledgeable about the legal as well as business issues that impact the industry, providing value added counsel in connection with the purchase, sale and development of shopping centers.
We counsel our clients on all phases of a transaction, including structuring and negotiating the deal, forming the appropriate entity, performing or coordinating due diligence review, generating documentation, and overseeing the closing. We know that some of the most crucial issues for outparcel pads exist outside of the ground lease or purchase agreement. For that reason, we work closely with our clients to structure and negotiate the declaration of covenants, conditions and restrictions, reciprocal easement agreements, operating agreements, construction contracts, development agreements, consultants’ contracts, and hazardous material review that are essential for a fully integrated project.
Our attorneys provide practical and innovative solutions to transactions, both large and small, without getting bogged down in legalistic minutiae. We focus on what is important and keep that focus until the transaction closes and the client’s needs attained. Our attorneys are deal makers, not deal breakers.
